Uptide Terms of Use

These terms apply when you use the Uptide app on iOS, Android, macOS or the web, and the website uptideapp.com. Uptide is developed by an independent developer as a personal project (“we”, “us”). By creating an account or using Uptide, you agree to these terms. If you do not agree, please do not use the app.

1. Who can use Uptide

You may use Uptide if you are at least 13 years old, or older if the law in your country requires a higher age for digital services. If you are below that age, use Uptide only with the permission of a parent or guardian.

2. Your account

You can sign up with an email address and password, with Google or with Apple, or use Uptide as a guest.
Keep your sign-in details safe. You are responsible for what happens under your account.
A guest account exists only on the device and sign-in it was created with. If you delete the app or lose access to it before linking a sign-in method, the guest data may not be recoverable.
You can delete your account at any time under Settings › Account › Delete account. Deletion permanently removes your content and cannot be undone.

3. Your content

Everything you add to Uptide — tasks, habits, notes, projects, files and Pomodoro sessions — remains yours. You give us only the permission needed to store, sync, back up and display that content to you so the service can work. We do not sell your content and we do not use it to advertise to you. How your data is handled is described in the Privacy Policy.

You are responsible for the content you upload. Do not upload anything you do not have the right to share, or anything that is illegal.

4. Acceptable use

When using Uptide, you agree not to:

break the law or infringe the rights of others;
try to access other users’ accounts or data, or our systems, without permission;
interfere with the service, overload it, or bypass its security measures (including App Check);
reverse engineer, copy or resell the app, except where the law expressly allows it;
use the file storage to distribute malware or illegal material.

We may suspend or close accounts that seriously or repeatedly break these rules.

5. Free version and advertising

Uptide is currently free to use. The free version shows ads served by Google AdMob, as described in the Privacy Policy. If paid features are introduced in the future, their price and conditions will be shown before you buy, and purchases will be processed by the App Store or Google Play under their own terms.

6. Availability and changes

We work hard to keep Uptide running smoothly, but it is provided “as is” and “as available”. Features may change, be added or be removed, and the service may occasionally be interrupted for maintenance or for reasons outside our control. We recommend keeping your own copy of anything critical.

7. Third-party services

Uptide relies on services from Google (Firebase, AdMob, Sign in with Google) and Apple (Sign in with Apple, App Store). Your use of those services is also subject to their own terms.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, or for loss of data, profits or opportunities, arising from your use of Uptide or from not being able to use it. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

9. Intellectual property

The Uptide name, logo, design and software belong to their owner and are protected by law. These terms do not give you any right to use them other than to use the app as intended.

10. Ending your use

You can stop using Uptide and delete your account at any time. We may end or suspend access if you seriously breach these terms. Sections that by their nature should continue (such as 8 and 12) remain in effect after your use ends.

11. Changes to these terms

We may update these terms from time to time. Significant changes will be announced in the app or on this page, and the date at the top will change. Continuing to use Uptide after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Republic of Türkiye. This does not take away any mandatory consumer protection that applies where you live.

Uptide Kullanım Şartları

Bu şartlar; Uptide uygulamasını iOS, Android, macOS veya web üzerinde ve uptideapp.com web sitesini kullandığınızda geçerlidir. Uptide, bağımsız bir geliştirici tarafından kişisel bir proje olarak geliştirilmektedir (“biz”). Hesap oluşturarak veya Uptide’ı kullanarak bu şartları kabul etmiş olursunuz. Kabul etmiyorsanız lütfen uygulamayı kullanmayın.

1. Uptide’ı kimler kullanabilir

Uptide’ı en az 13 yaşındaysanız veya ülkenizdeki mevzuat dijital hizmetler için daha yüksek bir yaş sınırı öngörüyorsa o yaşın üzerindeyseniz kullanabilirsiniz. Bu yaşın altındaysanız Uptide’ı yalnızca ebeveyninizin veya velinizin izniyle kullanın.

2. Hesabınız

E-posta adresi ve şifreyle, Google ile veya Apple ile kaydolabilir ya da Uptide’ı misafir olarak kullanabilirsiniz.
Giriş bilgilerinizi güvende tutun. Hesabınız altında gerçekleşen işlemlerden siz sorumlusunuz.
Misafir hesabı yalnızca oluşturulduğu cihaz ve oturumla sınırlıdır. Bir giriş yöntemi bağlamadan uygulamayı siler veya erişiminizi kaybederseniz misafir verileri geri getirilemeyebilir.
Hesabınızı istediğiniz zaman Ayarlar › Hesap › Hesabı sil adımıyla silebilirsiniz. Silme işlemi içeriğinizi kalıcı olarak kaldırır ve geri alınamaz.

3. İçeriğiniz

Uptide’a eklediğiniz her şey — görevler, alışkanlıklar, notlar, projeler, dosyalar ve Pomodoro oturumları — size aittir. Bize yalnızca hizmetin çalışabilmesi için bu içeriği saklama, eşitleme, yedekleme ve size gösterme izni vermiş olursunuz. İçeriğinizi satmayız ve size reklam göstermek için kullanmayız. Verilerinizin nasıl işlendiği Gizlilik Politikası’nda açıklanmıştır.

Yüklediğiniz içerikten siz sorumlusunuz. Paylaşma hakkınız olmayan veya hukuka aykırı içerik yüklemeyin.

4. Kabul edilebilir kullanım

Uptide’ı kullanırken şunları yapmamayı kabul edersiniz:

yasaları çiğnemek veya başkalarının haklarını ihlal etmek;
izinsiz olarak başka kullanıcıların hesaplarına, verilerine veya sistemlerimize erişmeye çalışmak;
hizmete müdahale etmek, aşırı yük bindirmek veya güvenlik önlemlerini (App Check dahil) aşmaya çalışmak;
yasanın açıkça izin verdiği durumlar dışında uygulamayı tersine mühendislikle çözmek, kopyalamak veya yeniden satmak;
dosya depolama alanını zararlı yazılım veya yasa dışı materyal dağıtmak için kullanmak.

Bu kuralları ciddi şekilde veya tekrar tekrar ihlal eden hesapları askıya alabilir veya kapatabiliriz.

5. Ücretsiz sürüm ve reklamlar

Uptide şu anda ücretsizdir. Ücretsiz sürümde, Gizlilik Politikası’nda açıklandığı gibi Google AdMob tarafından sunulan reklamlar gösterilir. İleride ücretli özellikler sunulursa fiyatları ve koşulları satın almadan önce gösterilir; satın almalar App Store veya Google Play tarafından kendi şartları çerçevesinde işlenir.

6. Hizmetin sürekliliği ve değişiklikler

Uptide’ın sorunsuz çalışması için özen gösteririz; ancak uygulama “olduğu gibi” ve “mevcut olduğu ölçüde” sunulur. Özellikler değişebilir, eklenebilir veya kaldırılabilir; hizmet bakım ya da kontrolümüz dışındaki nedenlerle zaman zaman kesintiye uğrayabilir. Kritik bilgilerinizin kendi kopyasını saklamanızı öneririz.

7. Üçüncü taraf hizmetler

Uptide, Google (Firebase, AdMob, Google ile Giriş) ve Apple (Apple ile Giriş, App Store) hizmetlerini kullanır. Bu hizmetleri kullanımınız ayrıca kendi şartlarına tabidir.

8. Sorumluluğun sınırlandırılması

Yasaların izin verdiği ölçüde; Uptide’ı kullanmanızdan veya kullanamamanızdan doğan dolaylı zararlardan, veri, kâr veya fırsat kayıplarından sorumlu değiliz. Bu şartlardaki hiçbir hüküm, yasa gereği sınırlandırılamayan sorumluluğu veya tüketici olarak sahip olduğunuz yasal hakları kısıtlamaz.

9. Fikri mülkiyet

Uptide adı, logosu, tasarımı ve yazılımı sahibine aittir ve yasalarla korunur. Bu şartlar, uygulamayı amacına uygun kullanmanız dışında bunlar üzerinde size bir hak tanımaz.

10. Kullanımın sona ermesi

Uptide’ı kullanmayı istediğiniz zaman bırakabilir ve hesabınızı silebilirsiniz. Bu şartları ciddi şekilde ihlal etmeniz hâlinde erişiminizi sonlandırabilir veya askıya alabiliriz. Niteliği gereği devam etmesi gereken bölümler (8. ve 12. bölümler gibi) kullanımınız sona erdikten sonra da geçerliliğini korur.

11. Şartlardaki değişiklikler

Bu şartları zaman zaman güncelleyebiliriz. Önemli değişiklikler uygulamada veya bu sayfada duyurulur ve en üstteki tarih güncellenir. Bir değişiklikten sonra Uptide’ı kullanmaya devam etmeniz, güncellenmiş şartları kabul ettiğiniz anlamına gelir.

12. Uygulanacak hukuk

Bu şartlar Türkiye Cumhuriyeti kanunlarına tabidir. Bu durum, bulunduğunuz yerde geçerli olan zorunlu tüketici koruma haklarınızı ortadan kaldırmaz.
